Well, that was the basis for the "laying down" argument a bit 
back, that there was nothing that said that cards that someone 
"lays down" were necessarily discarded.

But any way you look at it, that rule is badly phrased, and 
removing the specified sentence is less safe than rephrasing 
it would be.
