I think the first part of your new proposal has already been proposed.

However, I believe you are right. Attempted Murder is broken.
As such, I submit the following CFI, with 0x44 as the Defendant:

{
     The recent Attempted Murder that was Committed by the player 0x44 was 
ineffective.
}

Arguments: Rule 86 states that "A player cannot Commit Attempted Murder if eir 
Location and any other player's Location (in that order) are a Peephole." While 
this may be broken, the rule is clear that it is ANY other player's Location, 
and therefore, the Attempted Murder was IMPOSSIBLE.

Also, as Attempted Murder has time limits on its associated actions, I request 
that the Oracle and the to-be-assigned Judge carry out eir respective duties 
soon.
