[Spoon-business] Rulings on CFIs 1158, 1159


CFI 1158:

I rule each of these to be TRUE.

Analysis:

Rule 1081, subsection A.8.1 defines tea as "a non-alcoholic beverage...with a natural unit of one Cup;" similarly, subsection A.8.2 defines coffee as "a non-alcoholic beverage whose quantity is measured in cups."  Therefore, since both coffee and tea are defined as substances that come in one-cup units, that serves as regulation for the purposes of Rule 18 to determine how quantities of coffee and tea are represented.

Since Rule 1148 states that tea and coffee are dispensed, but does not give a quantity, it must be surmised that the regulated unit of one cup is used.

Therefore, when It dispenses tea or coffee, it dispenses cups of tea or coffee.  Note that nowhere in the rules does it state or imply that said coffee is in any sort of container, except possibly a gnome.

With regards to the defendent's analysis, it does not appear to be applicable to these CFIs, especially in light of the Administrator's recent interpretation of It's dispensing.  The literal wording of the CFIs is confirmation that It dispenses tea and coffee as defined in Rule 1081, in quantities defined in Rule 1081.  Whether or not said units of coffee or tea are freely available is not addressed in these CFIs.
